Foreign Acquisition of Property
Foreigners do not enjoy the same property rights in Mexico as Mexican citizens. However, there are a couple ways that allow someone to get the same bennefit of "owning" a property without actually owning it.
Fideocomiso
This is a Mexican Property Trust. A Mexican bank of your choice holds title to the property and you act as the beneficiary of the title. Simply put, you get to enjoy the property, rent it out as an investment, or sell it. When setting up a Fideocomiso, the benneficiary must make sure that he/she continues to renew the trust every 50 years. There is no limit on renewing the fideocomiso. The process of establishing a fideocomiso can take a few months and it is important to have a lawyer looking after your best interests.
Mexican Corporation
Like any corporation, you will need at least two partners. Once established, the corporation will acquire the propertty. You can also use the corporation to acquire other assets or start businesses. The process of creating a Mexican corporation is relatively cheap and fast.
Residency Requirements
Mexico does not require a foriegn purchaser of property to be a resident or have some special immigration status. Nonetheless, we can stil help purchasers of property simultaneously apply for a visa.
